Rental Period
Security Deposit:
A security deposit of 20% of total amount is required prior to the commencement of the rental period. This deposit will be refunded within 3 days of the conclusion of the rental, provided the equipment is returned in satisfactory condition.
Condition of Equipment:
All equipment provided by Mangoni Merchants is provided in good working condition. Any pre-existing damage or defects are documented prior to rental period by Mangoni Merchants. The renter agrees to return the equipment in the same condition, excepting normal wear and tear. Broken or damaged items can be replaced by renter with a like for like item at their own cost, or can be replaced by Mangoni Merchants for the retail cost of the broken/ damaged item, in which case an additional invoice will be sent to renter with associated costs. Invoice to be paid in full by renter.
Liability and Insurance:
The renter assumes full liability for any damages, injuries, or losses arising from the use of the rented equipment.
Use Restrictions:
The equipment is to be used only for its intended purpose which is for decorative and display purposes only. It shall not be used for any of the following, including but not limited to: seating, steps, structural purposes, weight bearing activities, structural supports. Any modifications or alterations to the equipment are strictly prohibited.
Maintenance and Repairs:
The renter is responsible for maintaining the equipment in good working condition during the rental period. Normal wear and tear are expected, but the renter will be liable for any damages resulting from misuse or negligence.
Delivery and Pickup:
Delivery and pickup of the equipment can be arranged for an additional fee as per the installation option during checkout. 48 hour rental period commences from time of pick up or delivery. The renter must provide adequate access to the rental location at the scheduled times.
Cancellation Policy:
Cancellations made 48 hours or more before the start of the rental period will incur no penalty. Cancellations made within 48 hours of the start date will result in a forfeiture of the security deposit.
Indemnification Clause:
The renter agrees to indemnify and hold harmless the equipment owner from any claims, damages, or losses arising from the rental or use of the equipment.
Jurisdiction and Dispute Resolution:
This agreement shall be governed by the laws of Victoria, Australia. Any disputes arising under this agreement shall be resolved through mediation or arbitration in Melbourne, Victoria.
Termination of Agreement:
Either party may terminate this agreement with 48 hours written notice to the other party. Termination of the agreement shall not relieve the renter of their obligations incurred prior to termination.
Rental Period
Total Rental period is 48 hours. The rental period commences from moment of pick up/ delivery, and pick up/ delivery must be within 24 hours of selected event date and time. If installation is required, the renter must be able to accept items up to 24 hours prior to selected date/time to allow for adequate installation time. The renter must notify Mangoni Merchants when the event will be completed.
